3-MMC: Bitch had to go!

After 4-MMC got banned everywhere, the NPS “industry” started selling pointless shit substances. 4-MMC had already vanished about half a year before the ban; they would send you unpleasant and disappointing, mislabeled alternatives like the later, in 2010, openly advertised “NRG 1” (Naphyrone) and, also announced in 2010, “NRG 2” (4-MEC / 4-EMC). “NRG 3” was claimed to be a questionable blend containing the stimulant NEH and the Dissociative MXE, and by 2012, 3-MMC aka “NRG-4” was finally discovered by Swedish authorities. As far as I can tell, a structural isomer of 4-MMC had never been legal in most countries.

SINCE I WAS ASKED:

I may have wasted about 120 on shit substances those days and decided to not care about NPS for three or four years at all. I am not under the impression I could have missed anything.

This would be my recommendation to all of you asking me about vendor recommendations.
The quality they offer is just shit right now. Pass on it, don’t fall for that stupid marketing hype.

Implementing International Directives

The Netherlands finally implemented some recommendations/agreements on banning certain Novel Psychoactive Substances as agreed with and issued as Directives by the EU Commission, recommendations/agreements on scheduling substances as issued under the Single Convention on Narcotic Drugs by the WHO/UNODoc (= CND (The Commission on Narcotic Drugs)).

Also, on the recommendation of the Dutch State Secretary of Health, Welfare, and Sport, Mr. Paul Blokhuis from 19 July 2021, who had requested the Dutch Coordination Point Assessment Monitoring new drugs (CAM) to carry out a multidisciplinary risk assessment into the harmfulness of 3-MMC as a matter of urgency.

This risk assessment done by the Dutch CAM (Institution coordination point Assessment and Monitoring of new drugs) was completed in May 2021 and contains the recommendation to place 3-MMC on list II of the Opium Act.

The CAM considers placement on List II justified in view of the increasing popularity of this drug, especially among young people, signals that indicate addiction potential of this drug and an increase in the number of health incidents related to 3-MMC use.

3-methyl-methcathinone or 3-MMC is a new psychoactive substance (NPS) that belongs to the 3-MMC synthetic cathinones and has been found on the drug market for several years. In 2020, signals were received about a noticeable increase in the use of this drug and concerns about the health effects of this use. The number of reports of mild to severe incidents due to 3-MMC use has increased, as has the demand for information about the drug. User experiences indicate an addiction potential of 3-MMC. The easy availability, low price, and legal status may lower the threshold for use.

The CAM concluded that there is not known enough about 3-MMC to justify adding it to List 1 on the basis of the information available at that time, as with hard drugs such as cocaine and heroin placed on List I of the Opium Act. In other words: Although having caused fatalities and produced addicts and health problems, especially among teenagers, there is not enough reliable scientific data available that could have justified to make 3-MMC a schedule I.

By placing 3-MMC on list II of the Opium Act, the easy availability due to the legal status is prevented and the user group is warned of the negative effects of using this substance. The recommendation of the CAM has been followed and
has led to this decision adding 3-MMC to list II to the Opium Act.

Findings of the Dutch experts and the government:

Research has shown that the drug 3-MMC poses health risks. This conclusion is based on the increased number of health incidents due to the use of 3-MMC and signals that indicate an addiction potential of this drug. At the same time, there is an identifiable increase in the use of 3-MMC by groups of (vulnerable) young people in particular, which is partly caused by the easy availability of the drug.

That is why the government chooses to prohibit the trade in the drug 3-MMC, by adding it to list II.

The aim of these rules is to ensure that fewer people have access to the means 3-MMC. The rules are therefore justified in the interest of public health.

It is important here that less far-reaching measures such as warnings on the packaging or restrictions on sales will not be sufficient to protect public health.

A complete ban is the only effective measure because no safe use is possible.

Writing and sharing the candid letter helps Pepin’s parents to process the loss. They also hope to be able to give a message to other parents. ‘What we feel now is that our adolescents are more vulnerable than we think. Their brains are still forming. They need so much care in this corona time. They may be even more vulnerable than the elderly over 80. Their ‘underlying suffering’ is of a very different order than that of the seniors, but just as fragile. Let’s hold them. Really get to know. Support. They need us, they need each other.’

The letter concludes with, it seems, an outright message to the cabinet. ‘For God’s sake, let’s think carefully about what we are doing to each other and our children with drastic measures to eradicate a virus that hardly bothers them themselves, and that will never go away.’

Slowly but surely, the parents noticed that Pepijn ended up in a rut. He wanted tension in his life again. Go on an adventure again. After an evening of socializing with his friends, his drug use came to light, about a week before his death. It was 3mmc, a designer drug (..). “But it’s legáál!” was his defence. ‘His adolescent brain did not yet understand that what is legal is not necessarily OK. He seemed impressed. He vowed not to use drugs anymore, because the aftereffects were bad for him. It sounded convincing.’

Worsening problems

Several youth care providers have been seeing an aggravation of the problems that play a role among children for some time, the Inspectorate for Health care and Youth (IGJ) observed last week. Both youth mental health care, youth care and parenting help see an increase in suicidal behavior and eating disorders. (..)

A few days after the ban on the controversial designer drug 3-MMC, Dutch webshops have already started offering its ‘successor’. A worrying development, according to the Ministry of Health, Welfare and Sport. Addiction treatment institutions Jellinek and Novadic-Kentron warn drug users that they should beware of the consequences of the completely unknown substance. “Because you really are your own guinea pig.”

The ban on the previously legally available 3-MMC came into effect on Thursday after months of discussions. The drug became increasingly popular in recent years and caused a series of (health) incidents throughout the country. With frequent use, the drug can lead to palpitations, insomnia, and tense muscles. Several users have died from the effects of the cheap and easily available drug.

Due to a small adjustment, it is just another substance and does not fall under the opium law.

“Downright lousy”

The Ministry of Health, Welfare and Sport is not happy about it. “The fact that providers are trying to come up with as comparable an alternative as possible to 3-MMC is downright lousy and worrying for public health and the well-being of people,” says spokesman Ruben van Dorssen.

“But it’s not surprising. Precisely in order to be able to tackle these types of situations better in the future, State Secretary Blokhuis is working on a bill that will allow entire groups of new psychoactive substances to be tackled at once.”

Addiction care institutions are also not surprised by the rapid rise of the new party drug. “When substances are banned, you often see that providers respond to this by offering a new substance that is not ‘yet’ on the opium law,” explains prevention worker Daniëlle Ketelaars of Novadic-Kentron. “Often these substances are very similar, but due to a small adjustment, it is just another substance and does not fall under the opium law. But just because a drug isn’t on the opium law doesn’t mean it’s not harmful to you.”

The danger of a new substance is that little is known about the possible risks, says Ketelaars. “It hasn’t been used much yet, so we don’t really know what the effects are. So you are actually your own guinea pig.” Jellinek, one of the largest Dutch institutions for addiction care, agrees. “We are completely in the dark about what this new drug does to people. The fact that webshops are now pushing this is therefore not a good development,” says a spokesperson.

New ideas needed?

According to addiction care institution Jellinek, it is high time that the government chooses a different approach to the drug problem. “All studies show that banning hard drugs has had very little effect on consumption in the Netherlands. Then you can happily continue with that, but where and when does it stop? We think it is much safer to release such resources into society in a controlling way. So regulate. That way you have influence on how and where Dutch people use it and what the quality of the drug is. I think it’s time to have that discussion.”

The Dutch 1a – A broader ban planned for 2022

Incidentally, this is not the first time that a new variant of a prohibited drug has come onto the market. “We saw it with 4FA, for example. This was widely used a few years ago and eventually resulted in relatively many health incidents, such as brain hemorrhages. After the incidents, it was then placed on the opium law,” says Ketelaars.

In the meantime, the outgoing cabinet is working on a broader ban on designer drugs. The idea behind this is to ban entire groups of raw materials that have the same basic chemical structure, so those producers can less easily come up with a newly legal product. Last Friday, the proposal was discussed in the Council of Ministers and approved.

The Council of State is now being asked for advice and then it will be presented to parliament for consideration. The ministry hopes that the law (Dutch 1a) will be active by mid-2022.

Bill Blokhuis and Grapperhaus soon to place whole substance groups of designer drugs on list Ia of the Opium Act

Drug producers and traffickers are creative in finding ways to circumvent the Opium Act. They do this, for example, by developing new psychoactive substances (NPS), also known as designer drugs. These are new substances that are very similar to hard drugs that are already on the List I of the Opium Act but are not yet prohibited in our country. (..) The problem is that if such a new substance is brought under the Opium Act, a new substance is made with a slightly different composition so that the substance falls outside the drug legislation. In order to halt this development, State Secretary Blokhuis (VWS) and Minister Grapperhaus (J&V) are today consulting a bill that makes it possible to also ban substance groups.

List Ia

The proposal is to add a new ‘List Ia’ to the Opium Act, which criminalizes certain high-risk substance groups. By placing a substance group under the Opium Act, all substances that can be derived from the basic chemical structure of a substance are banned in one fell swoop. For example, a whole group of designer drugs does not get a chance in advance, regardless of the specific composition. In Germany and Belgium, such a ban is already being successfully implemented. State Secretary Blokhuis and Minister Grapperhaus aim to protect public health as well as to prevent the production and trade of these substances.

State Secretary Blokhuis: “The substances that are on List I of the Opium Act are there for a reason. These are drugs with demonstrably high health risks. Of the designer drugs derived from this, we can assume that they can just as well cause great health damage. Consider, for example, substances that are derived from a heavy substance such as Fentanyl. As a precaution, we are therefore now taking measures. By banning certain groups of substances, we also remove the impression among users that these substances are not so harmful, because they are initially legally on the market.”

Minister Grapperhaus: “Behind designer drugs is a harsh world in which people are intimidated and threatened, in which our residential areas and our environment are seriously endangered and serious criminals make enormous financial profits that threaten to corrupt our legal economy through money laundering. This legislative amendment helps to tackle this subversive crime. Drug manufacturers and traffickers now often know how to escape the dance with new substances. By banning certain groups of substances, our investigative services can act more quickly. We can also work more together internationally and better comply with requests for legal assistance from other countries, where these substances are already banned.”

Three substance groups

In the consultation, Blokhuis and Grapperhaus propose to place three substance groups on List Ia of the Opium Act and thus ban them. These are three common substance groups that have already been banned abroad by this means and that are derived from individual substances that are already on the List I of the Opium Act. With this ban on certain substance groups, users are warned about the health risks associated with these designer drugs. At the same time, it contributes to the fight against drug crime, which has partly moved to the production and trade in these substances that are not (yet) prohibited.

Substances derived from 2-phenethylamine, cannabimimetic or synthetic cannabinoids, and substances derived from 4-aminopiperidines.

In October, the Dutch government banned A-PHP, 3-MMC, 4-CMC, as well as some Fentanyl-Analogs, Cannabinoids, and Benzodiazepines.

Last week, the proposal for the Dutch 1a was discussed in the Council of Ministers and FINALLY approved. This means this law will become reality. The ministries (Grapperhaus and Blokhuis will prepare that law) hope that the new law will be in force by mid-2022. This change in Dutch Drugs legislation is known as the Dutch 1a and will ban whole substance classes: Cathinones, Amphetamines, Cannabinoids, Opiates, Phenyltamines, and maybe more – my knowledge in chemistry is a tad poor.
